IRCC Gives Reasons for Making Changes in Express Entry System

Immigration, refugees and citizenship Canada (IRCC) has put forward reasons as to why it made changes in the required duration in the Express Entry pool of qualifying job offers for candidates. IRCC mentioned that it found some drawbacks in the system before it decided to bring improvements in the system last month.

The job offer was required to be of intermediate length in the previous Comprehensive Ranking System (CRS). Candidates who are eligible under the Federal Skilled Trades Class (FSTC) are exempted from this rule. They will be given CRS points for an offer of employment whose duration is at least one year.

According to the new rules put into force by IRCC from November 19, the duration of job offer has been changed to a minimum of one year from intermediate for all the programs. This rule is also applicable on candidates who apply through the Canadian Experience Class (CEC) and the Federal Skilled Worker Class (FSWC).

Starting from November 19, 200 CRS points are awarded for qualifying job offers in the Senior Managerial group and 50 CRS points are given for skilled position (levels 0, A and B of the NOC).

The definition of qualifying job offer has also changed and those individuals who were not qualified previously have also been included. An applicant was supposed to have a job offer before the changes took place on November 19. The job offer needs to be approved by Labor Market Impact Assessment (LMIA) in case they want to acquire points for qualifying job offer.

From November 19, points can be given to candidates for a qualifying job offer provided they have been working for at least one year for the employer that is named on the work permit. Points can also be given in case their present employer gives an employment offer for duration of at least one year.

Reason behind these Changes

According to IRCC, many employers do not wish to undergo the process of LMIA, which puts foreign nationals at a disadvantage. Many individuals who had the potential to establish in Canada were unable to do so because of this reason.

During a presentation at the Law Society of Upper Canada’s Immigration Law Summit, a spokesperson from IRCC stated the example of a senior executive who also had a job offer. A senior executive does not require an LMIA in case he or she comes to work to Canada as intra-company transferee.

Applicants See More Hope in PNP-Specific Express Entry Draws

The Express Entry draw that took place on November 30 saw a significant change that took place in draws that were held before that. Immigration, refugees and citizenship Canada (IRCC) invited only those candidates that had provincial nomination and these has made other candidates to make changes in their application to seek maximum benefit in the coming time.

The latest draw was the 48th one ever since the Express Entry system was launched for the first time almost two years back. It has happened for the first time that only those candidates were invited who were issued the provincial nomination certificate under the Provincial Nominee Program (PNP).

It was only in February 2015 draw that a program specific draw took place. At that time, candidates who were eligible as per the Canadian Experience Class (CEC) were given the invitation to apply (ITA) provided they fulfill the minimum cut-off threshold for Comprehensive Ranking System (CRS).

559 Candidates Issued ITA in November 30 Draw

The Comprehensive Ranking System went down to 786 and only 559 applicants in the pool were issued the Invitation to Apply (ITA). Those who were having provincial nomination were given 600 points in the CRS, which made PNP the most important factor for becoming the permanent resident of Canada.

This also indicates that candidates who scored just 186 point in core CRS were issued the ITA in the current draw. Core CRS is the points obtained by a candidate without a qualifying job offer or provincial nomination.

It can be said that the majority, if not all, of candidates with provincial nomination were given the ITA. A draw which was held before this one on November 16 had issued ITAs to candidates who had scored 470 or more points. It is because of this reason; numerous candidates updated their profile in the two weeks period after that.

During a recent Annual Immigration Law Summit it was announced by IRCC that aspiring immigrants will see more of program specific draw in the coming time. It is also possible that only those candidates will be invited who qualify under the Federal Skilled trades Class (FSTC) or Federal Skilled Worker Class (FSWC).

The development may not be welcomed by the Donald Trump office, as he prepares to start his work, with more cities like San Francisco, Philadelphia and Boston joining the group that opposes the proposal of deportation.

It should be noted here that there are people who strongly oppose the idea to legalize undocumented immigrants and they are calling for a stricter and swifter action to deport such people.

Dan Stein, the president of the Federation for American Immigration Reforms is in support of deporting undocumented immigrants, and he reasons that Trump administration is saying that we are not against the accommodation of these people, but why should other people pay for their services.
